Miami-Dade Circuit Court Judge Lawrence A. Schwartaz on Friday denied a motion to stop the count y from sellingthe bonds. Schwartz ruledd that while a pair Miamii residents have standing to bring the lawsuit challengingthe stadium's construction, the county’s effort to sell constructiohn bonds is “not unconstitutional.” The county had moved the date of the bond sale from this week to June 29 and June 30 as a resulty of their motion. The county had worriesd that the lawsuit would create a clour of uncertainty that could have affected the interest rates.
County spokeswoman Vicki Mallettee said Friday that the county would now move forwards with the sale of the bond sas planned. County Mayor Carlos Alvarezz said early Friday that he was confiden the county would prevail in the request for an Early Fridaymorning Miami-Dade County Commissionere approved three measures designed to make possible the start of construction on the new Commissioners agreed to move up to the top of the list of creditorsd to be paid first. Wachovia is providing a $100 milliomn letter of credit to the county for its variableerate bonds. These type of bonds require a lineof credit.
Commissioners also voted to move back the termination date to July 15 for eitherdthe county, city or the Marlins to pull out of the deal and to conveyh property to the city of Miami for stadiumm garages. Miami-Dade County Commissioner Joe Martine z voted againstprioritizing Wachovia's payback and changing the termination He opposes the county' s financing of the project, calling it "w bad deal." The ballparm project passed another technical hurdle at the city of Miamii on Thursday.
